These Terms of Service and Privacy Policy (hereinafter referred to as "Terms") set forth the conditions for using the application "AI Voice Recorder" (hereinafter referred to as the "App") provided by [MSK dev] (hereinafter referred to as the "Developer"). By downloading, installing, or using the App, you agree to these Terms.

Chapter 1: Terms of Service

Article 1 (Application)

These Terms apply to all relationships between the user and the Developer regarding the use of the App.

Article 2 (Prohibited Actions)

Users must not engage in the following actions when using the App:

1. Acts that violate laws, regulations, or public order and morals.
2. Acts related to criminal activity.
3. Acts that destroy or interfere with the functionality of the Developer's, other users', or third parties' servers or networks.
4. Acts that may interfere with the operation of the App.
5. Collecting or accumulating personal information concerning other users.
6. Unauthorized access or attempting unauthorized access.
7. Analyzing, reverse-engineering, decompiling, or disassembling the source code of the App.
8. Acts that infringe upon the intellectual property rights, portrait rights, privacy, reputation, or other rights or interests of the Developer, other users of the App, or third parties.
9. Other acts that the Developer deems inappropriate.

Article 3 (Disclaimer)

1. The Developer makes no express or implied warranty that the App is free from de facto or legal flaws (including flaws related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security-related defects, errors, bugs, infringement of rights, etc.).
2. The Developer does not guarantee that the audio recorded or text generated by the App will be accepted as legal evidence in court or by public institutions. Users assume all responsibility for the results of using the App.
3. The Developer shall not be liable for any damages (including data loss, device failure, mental distress, etc.) incurred by the user arising out of the App.

Article 4 (Governing Law and Jurisdiction)

The interpretation of these Terms shall be governed by the laws of Japan. In the event of a dispute regarding the App, the court having jurisdiction over the location of the Developer shall have exclusive jurisdiction.

Chapter 2: Privacy Policy

Article 5 (Information Collected and Purpose of Use)

The App uses the device's microphone and speech recognition features to provide its core functionality (recording and transcription).

• Audio and Text Data: All audio data recorded by the App and the text data generated from it are saved locally only on the user's device. The Developer does not transmit, collect, store, or view this data on external servers under any circumstances.

Article 6 (Use of Apple's Speech Recognition Technology)

The App uses the speech recognition API (SFSpeechRecognizer) provided by Apple Inc. for its transcription feature. While the App is designed to prioritize on-device processing, audio data may be sent to Apple's servers to improve speech recognition accuracy, depending on Apple's specifications and the user's device settings. Data processing in this context complies with Apple Inc.'s privacy policy.

Chapter 3: General Provisions

Article 7 (Changes to Terms and Policies)

The Developer may change these Terms at any time without prior notice to the user if deemed necessary. The revised Terms shall become effective when posted on this page.

本利用規約およびプライバシーポリシー（以下「本規約等」といいます）は、[MSK dev]（以下「開発者」といいます）が提供するスマートフォン向けアプリケーション「AIボイスレコーダー」（以下「本アプリ」といいます）の利用条件、および本アプリにおけるユーザー情報の取り扱いについて定めたものです。
ユーザーが本アプリをダウンロード、インストール、または使用した時点で、本規約等に同意したものとみなします。

第1章：利用規約

第1条（適用）

本規約等は、ユーザーと開発者との間の本アプリの利用に関わる一切の関係に適用されます。

第2条（禁止事項）

ユーザーは、本アプリの利用にあたり、以下の行為をしてはなりません。

1. 法令または公序良俗に違反する行為
2. 犯罪行為に関連する行為
3. 開発者、本アプリの他のユーザー、または第三者のサーバーやネットワークの機能を破壊したり、妨害したりする行為
4. 本アプリの運営を妨害するおそれのある行為
5. 他のユーザーに関する個人情報等を収集または蓄積する行為
6. 不正アクセスをし、またはこれを試みる行為
7. 本アプリのソースコードの解析、リバースエンジニアリング、逆コンパイル、逆アセンブル等を行う行為
8. 開発者、本アプリの他のユーザーまたは第三者の知的財産権、肖像権、プライバシー、名誉その他の権利または利益を侵害する行為
9. その他、開発者が不適切と判断する行為

第3条（免責事項）

1. 開発者は、本アプリに事実上または法律上の瑕疵（安全性、信頼性、正確性、完全性、有効性、特定の目的への適合性、セキュリティなどに関する欠陥、エラーやバグ、権利侵害などを含みます）がないことを明示的にも黙示的にも保証しておりません。
2. 開発者は、本アプリによって録音・テキスト化されたデータが、裁判や公的機関において法的な証拠として認められること（証拠能力）を一切保証いたしません。本アプリの利用による結果については、ユーザー自身がすべての責任を負うものとします。
3. 開発者は、本アプリに起因してユーザーに生じたあらゆる損害（データの消失、端末の故障、精神的苦痛等を含みます）について一切の責任を負いません。

第4条（準拠法・裁判管轄）

本規約等の解釈にあたっては、日本法を準拠法とします。本アプリに関して紛争が生じた場合には、開発者の所在地を管轄する裁判所を専属的合意管轄とします。

第2章：プライバシーポリシー

第5条（取得する情報および利用目的）

本アプリでは、そのコア機能（録音および文字起こし）を提供するために、端末のマイク機能および音声認識機能を利用します。

• 音声データおよびテキストデータについて：
  本アプリで録音された音声データ、およびそれをもとに生成されたテキストデータは、すべてユーザーの端末（デバイス）内にのみローカル保存されます。開発者がこれらのデータを外部サーバーに送信、収集、保存、または閲覧することは一切ありません。

第6条（Appleの音声認識テクノロジーの利用）

本アプリの文字起こし機能には、Apple Inc. が提供する音声認識API（SFSpeechRecognizer）を使用しています。本アプリでは端末内（オンデバイス）での処理を優先するよう設計しておりますが、Appleの仕様およびユーザーの端末設定等により、音声認識の精度向上のために音声データがAppleのサーバーへ送信される場合があります。この際の情報処理については、Apple Inc. のプライバシーポリシーに準拠します。

第3章：一般条項

第7条（規約およびポリシーの変更）

開発者は、必要と判断した場合には、ユーザーに事前に通知することなくいつでも本規約等を変更することができるものとします。変更後の規約等は、本ページに掲載したときから効力を生じるものとし、変更後も本アプリの利用を継続した場合、ユーザーは変更後の規約等に同意したものとみなします。
